Terms of Service
The deal, written down plainly.
These terms
These terms apply to this website and to services provided by NGAGED LLC, doing business as NGAGED Marketing. If you sign a proposal or service agreement with us, that document controls wherever it differs from these terms.
Services
We build and host websites for local businesses, and we manage Google Ads and Meta (Facebook and Instagram) ads. The exact scope for each client is set out in their plan or proposal.
Websites — $30 a week, twelve months
- $30 a week, no setup fee, nothing upfront. Billing starts on the day you sign — you're buying a year of work, and the build is the heaviest part of it. Your site normally goes live within a few business days of us receiving your completed intake form.
- The agreement runs twelve months, and you are responsible for the weekly payments for the whole term. That commitment is what pays for a site built with nothing down. If you stop early, the remaining payments are still owed — we may keep charging weekly to the end of the term or ask for the balance in one payment.
- Payment is automatic. You keep a card or bank account on file with Stripe, our payment processor, and authorise us to charge $30 every week for the term. Stripe stores the details; we never see your card number.
- Late payment. A payment more than 7 days late carries a $15 late fee.
- Suspension for non-payment. If a payment is more than 10 days late we may suspend the service and take your website offline, after 3 days' written notice — the site stops being served, changes stop, and work in progress pauses. Service resumes only when the account is fully up to date, including any late fee, and your site goes back up within one business day of that. Nothing is deleted while suspended. Time offline is not refunded, the term keeps running and the balance is still owed. An account unpaid for 30 days may be ended and the site taken down permanently.
- Card disputes. Email us before disputing a charge with your bank, and give us five business days to put it right.
- After the twelve months, the agreement continues week to week. Either of us can end it with 14 days' written notice.
- We host the site as part of the fee, so when the agreement ends the site comes off our hosting. Finish your twelve months and you keep a free copy of the finished website — the pages as your visitors saw them, as files you can host anywhere — if you ask within 30 days of your last day. End it early, or lose the site to non-payment, and there is no copy. Your domain, your content and your leads sheet are yours either way. The detail, including the fact that the contact form stops working once the site leaves our hosting, is section 12 of the Website Agreement.
- Your domain name stays registered in your name. We never need your registrar login — you point the domain at our hosting.
- Where your leads go. Form submissions are emailed to you and written into a Google Sheet we share with the email address you give us. We don't connect websites to CRM systems, and we don't set up, configure or manage them. Phone inquiries go straight to the number you give us — we display your number, we don't route or record your calls.
- Changes are included, weekly. Send us content changes any time — hours, prices, photos, staff, adding or removing a service — and we make them in a weekly batch. New pages, redesigns and new features are quoted before any work starts.
- What we don't build. We do not build e-commerce, shopping carts, online checkout, card payments on your site, online ordering or customer logins — in any form. A NGAGED website generates phone calls and form inquiries. Where you already use a third-party booking tool we can link to it; we don't build, host or support booking systems. New pages and redesigns are quoted before any work starts.
Every website client signs a two-page agreement covering all of this before work starts. You read it first, and nothing in it is a surprise.
Our hours, and how we work with you
Email and build work: Monday to Friday, 10:00am to 5:00pm Central. Calls and Google Meets are booked in the evening, Monday to Friday, 5:30pm to 9pm Central — most of the businesses we build for can't take a call mid-afternoon. Some Saturdays are available too, but they vary week to week and are not promised — the booking page shows exactly what is open, and if nothing is showing for a Saturday, that week is closed. Closed Sundays and public holidays. Day to day, everything runs by email or a scheduled Google Meet — it keeps decisions written down. We reply to email within one business day. If a live site goes down, email us and we treat it as urgent during our hours.
We can decline or end the work
We may refuse or end a service at our discretion, on written notice — for example where content is unlawful, dishonest, hateful or unsafe, where we're asked to publish claims we believe are untrue, where someone is abusive to us, or where continuing would breach a platform's rules or the law. If we end it, you are not charged for anything after that point and our Refund Policy applies.
Ads management: fees and ad spend
- Google Ads — $750 a month. About $173 a week.
- Meta Ads — $600 a month. About $138 a week.
- Both together — $1,000 a month. About $231 a week, and $350 a month less than buying them separately.
- No setup fees. Fees are billed monthly in advance, starting the day you sign.
- Your ad budget is separate and always yours. It is not included in our fee. You pay Google or Meta directly with your own payment method, and we never collect, hold or mark up ad spend. How much to spend is agreed with you on a consultation call, based on your area and trade, and you can change it at any time.
- Each ads engagement has its own written agreement covering scope, reporting and cancellation.
Term and cancellation for ads
Ads plans run for a three-month minimum term, because automated bidding needs roughly 30 to 90 days of data before it can optimize properly — judging a campaign sooner isn't fair to you or to us. After the three months, plans continue month to month and you can cancel with 30 days' written notice. If you cancel inside the three months, the remaining months of the term are still payable.
Your responsibilities
- Give us accurate information about your business, services, prices and service area
- Make sure the claims your business makes — licenses, guarantees, prices, reviews — are true
- Only send us photos and content you have the right to use
- Give us timely access to the accounts we manage, and keep a payment method on file with the ad platforms
No guaranteed results
Marketing results depend on your market, budget, competition, offer and the ad platforms, none of which we control. We don't guarantee any ranking, number of leads, cost per lead or revenue. We will always report your results honestly, including when they aren't good.
Ownership
You own your domain, your ad accounts, your customer data, your reviews and the content you give us — your words, photos and logo. We own our own software, templates, tools and methods, including the code our website subscriptions run on.
Third-party platforms
Google, Meta and other platforms set their own policies and can reject ads or suspend accounts. We work within those policies, but decisions made by the platforms are outside our control.
Confidentiality
We treat your business information, account data and results as confidential and use them only to provide our services to you.
Limitation of liability
To the extent the law allows, our total liability arising from our services is limited to the fees you paid us in the three months before the claim, and we are not liable for indirect or consequential losses such as lost profits.
Governing law
These terms are governed by the laws of the State of Texas. Any dispute will be handled in the courts of Tarrant County, Texas.
Changes
We may update these terms. The date at the top of this page shows when they last changed.
Refunds and cancellation
How cancelling works, and what is and isn't refunded, is set out in full in our Refund & Cancellation Policy.
